Acceptance of terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and Floating IQ ("Company", "we", "us") governing your use of the Floating IQ platform, website, and all related services (collectively, the "Service").

By accessing or using the Service, you confirm that you are at least 16 years old, have the legal capacity to enter into this agreement, and accept these Terms in full.

Description of the service

Floating IQ is a marketing analysis platform that provides:

• Automated website audits covering SEO, conversion, content, and brand scoring
• AI-generated marketing recommendations, action plans, and implementation assets
• Integration with third-party marketing platforms including Google Ads, Meta Ads, Google Search Console, Gmail, and Reddit
• AI-powered analysis of connected platform data
• Content generation tools for marketing copy and ad creative

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

Your account

You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately of any unauthorized access to your account.

• You must provide accurate and complete information when creating your account
• One person may not maintain multiple accounts
• You are responsible for all activity that occurs under your account
• You must not share account access with others unless using a plan that explicitly allows it

Third-party integrations

The Service connects to third-party platforms on your behalf. When you connect an integration, you authorize us to access and process data from that platform as described in our Privacy Policy.

Google Ads Integration: By connecting your Google Ads account, you authorize Floating IQ to access supported Google Ads data. You remain solely responsible for your advertising accounts, campaign strategy, and all advertising spend. Supported management actions may modify Google Ads resources; however, such management actions require your initiation or explicit approval through supported workflows. You should carefully review all AI-generated recommendations before approving actions. Floating IQ does not guarantee advertising performance, return on ad spend (ROAS), conversions, revenue, or specific campaign outcomes.

You may disconnect any integration at any time from your Integrations page. Disconnecting an integration revokes our access to that platform's data immediately.

OAuth & Data Security

When you connect a third-party account, we securely manage your authorization tokens to ensure your data remains safe:

• AES-256 Encrypted Storage: All OAuth tokens are encrypted at rest using industry-standard AES-256 encryption.
• Immediate Deletion: Upon disconnecting an integration, your associated OAuth tokens are immediately and permanently deleted from our servers.
• No Data Sales: Floating IQ never sells your personal data or integration data to third parties. This policy applies strictly to all integrations including Google Ads.

Google Ads Mutation Approval Requirement

Floating IQ acts as an advisory tool and NEVER executes Google Ads mutations automatically without your direct intervention.

Every single action on your Google Ads account requires your explicit approval via an Approve/Reject user interface. We support the following mutations, all of which strictly require user approval:

• Budget updates
• Campaign pause / resume
• Keyword pause / resume
• Negative keyword management
• Responsive Search Ad creation
• Geo targeting updates
• Smart bidding (Target CPA / Target ROAS) updates

Acceptable use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

• Use the Service to violate any applicable law or regulation
• Connect accounts or platforms you do not own or have explicit authorization to access
• Use AI-generated content in a way that violates the terms of any third-party platform
• Attempt to reverse engineer, decompile, or extract the source code of the Service
• Use automated tools to scrape or extract data from the Service in bulk
• Share, sell, or sublicense access to the Service to third parties
• Use the Service to generate spam, misleading advertising, or deceptive content
• Attempt to interfere with, disrupt, or gain unauthorized access to the Service's infrastructure
• Impersonate any person or entity when using the Service

Intellectual property

The Service, including its design, code, branding, and original content, is owned by Floating IQ and protected by intellectual property laws.

You retain ownership of all data you bring into the Service — your website content, your ad data, your uploaded files. We do not claim ownership of your data.

AI-generated outputs (recommendations, ad copy, action plans) produced by the Service for your account are yours to use, subject to the limitations in Section 07 below.

AI-generated content

Floating IQ uses AI models to generate marketing analysis, recommendations, and content. By using the Service you acknowledge that:

• All AI recommendations are strictly advisory until explicitly user-approved.
• AI-generated content may contain errors, inaccuracies, or outdated information
• You are responsible for reviewing all AI-generated content before using or approving it
• We do not guarantee the accuracy, completeness, or fitness for purpose of any AI output
• AI-generated ad copy must comply with the advertising policies of the platform where you use it
• We are not liable for outcomes resulting from acting on AI recommendations without independent verification

Payments and billing

If you subscribe to a paid plan, the following terms apply:

• Subscriptions are billed in advance on a monthly or annual basis
• All fees are non-refundable except where required by law
• We may change pricing with 30 days' notice to your registered email
• Failure to pay may result in suspension of your account
• You are responsible for all taxes applicable to your subscription

To cancel your subscription, go to Account Settings → Billing → Cancel Plan. Cancellation takes effect at the end of your current billing period.

Export Your Data

You have the right to access and export your data from the platform. Users may request a data export at any time, including before account deletion.

To request an export of your data, please contact support@floatingiq.com.

Limitation of liability

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the fullest extent permitted by law, Floating IQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of or inability to use the Service.

Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

Termination

You may delete your account at any time from Account Settings. Upon deletion, we will remove your personal data within 30 days as described in our Privacy Policy.

We may suspend or terminate your account immediately and without notice if you:

• Violate any provision of these Terms
• Engage in fraudulent, abusive, or illegal activity
• Fail to pay applicable fees after reasonable notice

Upon termination, your right to use the Service ceases immediately. Sections on intellectual property, limitation of liability, and disputes survive termination.

Third-party platform terms

Your use of connected integrations is also governed by the terms of those platforms. You are responsible for complying with:

• Google Ads Terms of Service and Advertising Policies
• Meta Platform Terms and Advertising Standards
• Reddit API Terms of Use
• Google API Services User Data Policy
• Any other platform you connect to the Service

Floating IQ is not affiliated with, endorsed by, or sponsored by Google, Meta, Reddit, or any other third-party platform.

Disputes and governing law

These Terms are governed by applicable law. Any dispute arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation between the parties.

If a dispute cannot be resolved informally within 30 days, it shall be submitted to binding arbitration. Class action lawsuits and class-wide arbitration are waived to the fullest extent permitted by law.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
